An employer of record (EOR) is a service provider offering legal employment capacity in a country where a client has no legal entity. Indeed, the recruited workers will obtain from the EOR provider located in this region their compliant labour status. They will be covered by the related labour law, sign employment contract, pay their taxes, insurance, and receive their benefits. EOR is the outsourcing of employment and HR functions applied to internal employees working abroad.

The EOR service is a HR and legal service at its core. It protects both the employee and employers against labour regulations. The scope of work, the obligations, the processes, the management, the culture, and most company practices are open to internal consideration. However, those should be considered in two perspectives: their local legality and their common usage. Acting as a local extension of a client's HR department, the EOR provider should advise on the best practices to promote a legal and positive working environment.

The employer of record then performs HR and legal functions:

  • Allow businesses to hire employees in other countries.
  • Ensure compliance with local labour and tax legislation (contract, registration...)
  • Cover tax and insurance (social insurance, unemployment insurance...) obligations on the employer’s behalf.
  • Manage the Payroll for the employees, PTO, overtime...
  • Advise the company regarding the best practices of employee onboarding, severance pay, or contract termination in the region.
  • (if necessary) Arrange visa-related documents and work permits in case the relocation of an international employee.
